Depending on how you use the website, we may process the following categories of personal data:
We process personal data only where a legal basis exists. In particular:
The yacht pages contain charter enquiry forms. Required fields currently include name, email address, telephone number, number of guests, charter option and charter start date. Optional information may include catering/accessory requirements and a free-text message. The submitted information is used to answer the enquiry, prepare an offer and, if requested, take pre-contractual steps.
Form submissions are transmitted to the business contact email address. Technical email and hosting providers may process the data on our behalf where necessary to deliver the message and operate the website.
If you contact us by email or telephone, we process the information you provide in order to respond to your request. If you choose to contact us through WhatsApp, your communication is also processed by WhatsApp/Meta under its own terms and privacy information. Depending on your location and the service configuration, this may involve processing outside the European Economic Area. Use of WhatsApp is voluntary; you may contact us by email or telephone instead.
Individual yacht pages currently embed Google Maps to show marina or mooring locations. When a Google Maps embed is loaded, technical information such as your IP address and device/browser data may be transmitted to Google. Where consent is legally required, Google Maps should be loaded only after the corresponding consent has been given through the website’s consent mechanism. Google may process data in countries outside the European Economic Area subject to the safeguards applicable to its services.
The website uses cookies and comparable technologies that are necessary for technical operation and may use optional technologies where the visitor has given consent. Essential cookies may be used without consent where they are strictly necessary to provide a service expressly requested by the user. Non-essential cookies or third-party technologies must be activated only after the required information and consent have been provided. Consent can be changed or withdrawn through the website’s cookie/consent controls where available.
No separate analytics or advertising platform was detected on the reviewed non-shop pages at the time of this update. This statement does not cover the shop, checkout or customer-account areas.
Personal data may be made available to service providers that support website hosting, website maintenance, email delivery and other necessary technical services, strictly to the extent required for those services and, where applicable, under data-processing agreements. Data may also be disclosed to public authorities or other recipients where required by law. We do not sell personal data.
Some third-party services, including services provided by Google or Meta/WhatsApp, may involve processing in countries outside the European Economic Area. Where such transfers occur, they must be based on an applicable adequacy decision or other safeguards recognised under Chapter V GDPR, such as appropriate contractual safeguards, as applicable to the provider and service concerned.
We retain personal data only for as long as necessary for the purpose for which it was collected and for any subsequent period required to comply with legal obligations or to establish, exercise or defend legal claims. Enquiry data that does not lead to a contract is deleted or anonymised when it is no longer needed for the enquiry and any reasonable follow-up, unless a longer period is required by law or justified by a legal claim. Technical logs are retained only for the period necessary for security, troubleshooting and operation, subject to the hosting configuration.
Subject to the conditions of the GDPR, you may request access to your personal data, rectification of inaccurate data, erasure, restriction of processing, data portability and objection to processing. Where processing is based on consent, you may withdraw that consent at any time without affecting the lawfulness of processing carried out before withdrawal.
To exercise your rights, contact info@topyachtscharter.com. We may need to verify your identity where this is necessary to protect your data.
You also have the right to lodge a complaint with the Spanish Data Protection Agency (Agencia Española de Protección de Datos – AEPD), the competent supervisory authority in Spain: www.aepd.es.
The reviewed non-shop website functions do not use automated decision-making that produces legal effects or similarly significant effects on visitors.
We use appropriate technical and organisational measures designed to protect personal data against accidental or unlawful destruction, loss, alteration, unauthorised disclosure or access. No internet transmission or storage system can, however, be guaranteed to be completely secure.
This website and the yacht charter services presented on it are not directed at children. We do not knowingly request personal data from children through the reviewed non-shop enquiry functions.
